The Memorial Collective Inc., operating as Tribute Art™, respects your privacy and is committed to protecting the personal information entrusted to us.

This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information when you visit the Tribute Art™ website, communicate with us, create an account, place an order, submit information for a personalized memorial, use our products or services, or otherwise interact with us.

References to “Tribute Art™,” “The Memorial Collective™ / Tribute Art™,” “we,” “us,” or “our” refer to The Memorial Collective Inc., operating as Tribute Art™.

Our ecommerce services are powered in part by Shopify, which provides technology used for shopping cart, checkout, payment, account, order-management, and related ecommerce functionality.

1. Information We Collect

The information we collect depends on how you interact with Tribute Art™ and the products or services you choose.

We may collect or process information such as:

  • email address;
  • telephone number;
  • billing and shipping addresses;
  • account information, preferences, and settings;
  • order and transaction information;
  • product selections and preferences;
  • payment and payment-confirmation information;
  • photographs, images, handwriting, text, stories, dates, names, and other materials you submit;
  • personalization and memorial information;
  • information you provide in connection with cremated remains;
  • communications with our team;
  • customer service inquiries;
  • reviews or feedback you choose to provide;
  • device, browser, network, and IP address information;
  • website usage and interaction information; and
  • other information you voluntarily provide to us.

Personal information generally means information that identifies you or can reasonably be linked to you or another identifiable individual. It does not include information that has been anonymized or de-identified so that it cannot reasonably be linked to an identifiable individual.

3. Memorial & Personalization Information

Many Tribute Art™ products are deeply personal. To create a personalized memorial product, we may ask you to provide photographs, names, dates, stories, memories, preferences, artwork instructions, or other information relating to you or the person being remembered.

We collect and use this information only for purposes reasonably connected with providing the product or service you have requested, communicating with you about your order, fulfilling your instructions, and operating our business.

Please only provide information, photographs, or other materials that you have the authority to share with us.

4. Information Related to Cremated Remains

Certain Tribute Art™ products, including Embellished Art, involve the incorporation of cremated remains.

Where applicable, we may collect information necessary to identify, track, process, and fulfill an order involving cremated remains.

This may include:

  • the customer's information;
  • the name or identifying information of the person whose cremated remains are being provided;
  • order and product information;
  • identification or tracking information associated with the remains;
  • shipping and receiving information; and
  • information necessary to coordinate with the artist or other authorized parties involved in completing the memorial.

We limit access to this information to individuals and service providers who reasonably require it to fulfill the order.

5. How We Use Your Information

We may use personal information to:

  • process and fulfill orders;
  • create personalized and custom memorial products;
  • communicate with you regarding an order;
  • process payments;
  • coordinate shipping and delivery;
  • provide customer service;
  • create and manage customer accounts;
  • coordinate with artists, manufacturers, printers, framers, fulfillment providers, shipping providers, and other service providers;
  • administer orders involving cremated remains;
  • provide digital products;
  • authenticate accounts and transactions;
  • prevent, detect, and investigate fraud, security incidents, illegal activity, or misuse of our services;
  • maintain business and transaction records;
  • improve our products, services, website, and customer experience;
  • comply with legal, tax, accounting, regulatory, and contractual obligations;
  • enforce our terms and policies; and
  • send marketing or promotional communications where permitted by law and in accordance with your preferences.

We will not use highly personal memorial information supplied for an order for unrelated purposes without appropriate permission.

6. Photographs, Stories & Memorial Content

Photographs, stories, names, personal messages, handwriting, and other memorial content you submit remain yours or the property of their respective rights holders.

By submitting this material, you authorize The Memorial Collective™ / Tribute Art™ to use it as reasonably necessary to create, personalize, manufacture, process, and fulfill your order.

Submitting content for an order does not automatically give us permission to publicly use your memorial, photographs, story, or personalized artwork for advertising or promotional purposes.

If we would like to feature a customer's story, memorial, photograph, or personalized product publicly, we may seek separate permission where appropriate.

7. Digital Products

When you purchase a personalized digital product, including products such as Life’s Song™, My Final Resting Place™, My Footsteps™, or other digital memorial offerings, we may collect and process the information necessary to create the requested product.

Depending on the product, this may include photographs, written responses, memories, preferences, stories, audio-related information, or other content submitted by you.

This information will be used to create and deliver the product and for other purposes described in this Privacy Policy.

8. Artists, Manufacturers & Fulfillment Partners

Some Tribute Art™ products require us to work with artists, printers, manufacturers, framers, fulfillment providers, shipping providers, funeral professionals, or other service providers.

We may provide these parties with information reasonably necessary for them to perform their role in fulfilling your order.

For example, an artist creating or embellishing a personalized piece may require access to certain photographs, personalization instructions, memorial information, or information necessary to coordinate an order involving cremated remains.

We seek to limit the information provided to what is reasonably necessary for the applicable service.

9. Payment Information

Payments made through Tribute Art™ may be processed through Shopify Payments or other third-party payment providers.

Payment information, such as credit or debit card details, may be collected and processed directly by the applicable payment provider rather than stored directly by The Memorial Collective™ / Tribute Art™.

Payment providers process information in accordance with their own privacy policies, security practices, and applicable terms.

10. Affirm

Where available, customers may choose to use Affirm to finance an eligible purchase.

If you choose Affirm, information necessary to apply for, process, or administer financing will be collected and processed by Affirm in accordance with Affirm's own terms and privacy practices.

The Memorial Collective™ / Tribute Art™ does not control Affirm's approval process or its independent collection, processing, or use of personal information.

11. Shopify & Ecommerce Services

Our ecommerce services use Shopify and related technologies to provide shopping cart, checkout, payment, account, order-management, fraud-prevention, and other ecommerce functionality.

Information you submit through these services may be transmitted to and processed by Shopify and other service providers necessary to provide and improve these services.

Shopify may process information in countries other than the country in which you reside.

We may also use certain Shopify features that use information obtained from interactions with our store, Shopify, and other merchants to provide or improve services, personalization, advertising, security, fraud prevention, or other functionality.

In circumstances where Shopify independently determines the purposes and means of processing personal information, Shopify is responsible for that processing and for applicable requests concerning that processing.

12. Shipping Providers

We may provide your name, shipping address, contact information, order information, and other information reasonably necessary to shipping carriers, couriers, fulfillment providers, manufacturers, customs authorities, or other parties involved in delivering an order.

For orders involving cremated remains, additional identifying or tracking information may be used where necessary to safely coordinate the process.

Some products may be shipped directly to you by one of our manufacturers or fulfillment partners.

13. Marketing Communications

Where permitted by applicable law and in accordance with your preferences, we may send communications regarding Tribute Art™ products, services, news, events, or other information that may be of interest to you.

You may opt out of receiving promotional emails at any time by using the unsubscribe option contained in the message.

Unsubscribing from marketing communications will not prevent us from sending non-promotional or transactional communications necessary to administer an existing order, account, payment, shipment, or customer-service request.

Our website and ecommerce services may use cookies and similar technologies to:

  • maintain shopping-cart and checkout functionality;

If you visit our ecommerce services with a recognized Global Privacy Control (GPC) opt-out preference signal enabled, we may treat that signal as an opt-out request where required by applicable law and where the technology supports doing so.

Other browser “Do Not Track” signals may not be recognized unless required by applicable law.

Tribute Art™ works with artists, manufacturers, technology providers, payment processors, shipping providers, and other service providers that may be located outside Canada.

When information is processed outside Canada, it may be subject to the laws of that jurisdiction and may be accessible to courts, governments, law enforcement, or regulatory authorities in accordance with applicable law.

Where applicable law requires specific safeguards for international transfers, we or our applicable service providers may rely on legally recognized transfer mechanisms.

19. How Long We Keep Information

Tribute Art™ products and services are intended to be purchased by adults.

We do not knowingly solicit personal information directly from children for the purpose of creating customer accounts or completing purchases.

Where a customer provides information, photographs, stories, or other content involving a child as part of a memorial or personalized product, the customer is responsible for having the authority necessary to provide that information to us.

If a parent or guardian believes a child has provided personal information directly to us without appropriate authorization, they may contact us to request that we review or delete the information as appropriate.

24. Third-Party Websites & Services

Our website or ecommerce services may contain links to websites, platforms, applications, or services operated by third parties.

We are not responsible for the privacy practices, content, security, accuracy, or availability of third-party websites or services that we do not operate.

We encourage you to review the privacy policies and terms of third parties before providing personal information to them.
