Welcome to Tribute Art™. These Terms & Conditions (“Terms”) govern your use of the Tribute Art™ website and your purchase of products and services offered through Tribute Art™.
Tribute Art™ is operated by The Memorial Collective Inc. References to “Tribute Art™,” “The Memorial Collective™ / Tribute Art™,” “we,” “us,” or “our” refer to The Memorial Collective Inc., operating as Tribute Art™.
By accessing our website, placing an order, or purchasing a product or service, you agree to these Terms.
1. Our Products & Services
Tribute Art™ offers a range of memorial products, artwork, personalized products, digital products, and related services designed to support meaningful remembrance.
Certain products are individually created, personalized, produced to order, hand-finished, or created using information, photographs, instructions, or cremated remains supplied by the customer.
Product availability, specifications, materials, dimensions, colours, finishes, production methods, and personalization options may vary by product. Please review the individual product page carefully before placing your order.
2. Product Images & Variations
We make reasonable efforts to accurately represent our products online. However, colours and details may appear differently depending on your screen, device, lighting, and other factors.
Handcrafted, hand-finished, embellished, artistic, and personalized products may naturally contain variations in texture, colour, placement, finish, and other artistic details.
These variations are part of the individual nature of the work and are not necessarily considered defects.
3. Orders
By placing an order, you confirm that the information you provide is complete and accurate and that you are authorized to make the purchase.
We reserve the right to refuse or cancel an order where reasonably necessary, including in circumstances involving suspected fraud, pricing or website errors, product unavailability, inability to fulfill the requested personalization, or other circumstances that prevent us from completing the order.
If we cancel an order for which payment has already been received and no product or service has been provided, the applicable amount will be refunded, subject to these Terms and applicable law.
4. Personalized & Custom Products
Certain Tribute Art™ products are created or personalized specifically for you.
You are responsible for reviewing and providing accurate names, dates, photographs, wording, instructions, selections, and other information requested during the ordering process.
Where a design approval process is offered, production may begin after the applicable design or proof has been approved.
The number of revisions included with a custom or digital product will be stated on the applicable product page. Additional revisions beyond those included may require an additional fee.
5. Photographs & Customer-Provided Content
When you provide photographs, images, text, handwriting, artwork, or other materials to Tribute Art™, you confirm that you own the material or otherwise have the necessary permission and authority for us to use it to fulfill your order.
You grant The Memorial Collective™ / Tribute Art™ permission to reproduce, modify, adapt, process, and otherwise use the submitted material as reasonably necessary to create and fulfill your purchased product or service.
Customer-provided materials remain the property of their respective owners.
6. Embellished Art & Cremated Remains
Tribute Art™ Embellished Art is a memorial product in which cremated remains are incorporated into the artistic medium as part of the embellishment process.
Cremated remains are required for Embellished Art and are not an optional component of this product.
After an applicable order is placed, instructions and the appropriate materials for providing the required portion of cremated remains will be sent to the customer.
The amount required varies according to the artwork selected. Any cremated remains provided but not incorporated into the artwork will be returned with the completed piece.
Customers must follow the instructions provided by Tribute Art™ when preparing and sending cremated remains.
Cremated remains entrusted to us will be handled with dignity, care, and respect throughout the process.
7. Authorization to Use Cremated Remains
By submitting cremated remains to The Memorial Collective™ / Tribute Art™, you represent and confirm that you have the legal authority and permission necessary to provide those remains and authorize their incorporation into the selected memorial product.
You authorize The Memorial Collective™ / Tribute Art™ and the artists, manufacturers, contractors, and service providers reasonably necessary to fulfill your order to receive, handle, prepare, transfer, and incorporate the required portion of the cremated remains into the authorized memorial product.
You are responsible for resolving any disagreement among family members, estates, executors, representatives, or other individuals concerning authority over the cremated remains before submitting them to us.
8. Digital Products
Certain Tribute Art™ products are delivered as digital files rather than physical products.
Digital product descriptions will identify what is included, the intended use of the file, and any applicable revision limits.
No physical product will be shipped where a product is identified as digital-only.
Customers are responsible for arranging any printing, framing, tattooing, fabrication, or other third-party service associated with a digital file unless expressly stated otherwise.
Results obtained from third-party printers, tattoo artists, fabricators, or other service providers are outside the direct control of The Memorial Collective™ / Tribute Art™.
9. Tattoo Memorial Art
Where Tribute Art™ provides a digital tattoo-ready memorial design, the completed file is intended to be shared with a professional tattoo artist of the customer’s choice.
Tribute Art™ does not provide tattooing services.
A tattoo artist may recommend adjustments based on placement, size, skin, technique, and other considerations.
The Memorial Collective™ / Tribute Art™ is not responsible for the application or final appearance of a tattoo performed by an independent tattoo artist.
10. Pricing
Prices are displayed in the applicable currency shown on the website and are subject to change without notice.
The price applicable to your purchase will be the price presented at the time the order is placed, subject to correction of obvious pricing or technical errors.
Applicable taxes will be calculated and charged as required.
11. Payment
Payment must be made using an accepted payment method available at checkout.
For most Tribute Art™ products, payment is due in full when the order is placed unless financing is selected and approved.
Different payment terms apply to certain Sculpture and Embellished Art purchases as described below.
12. Sculpture & Embellished Art Deposits
Eligible Sculpture and Embellished Art purchases may be secured with a 50% deposit at the time of order, with the remaining 50% due before the completed product is shipped.
Production may begin after the required initial payment has been received.
All outstanding balances must be paid in full before the completed product will be released for shipment.
Customers who choose an eligible Affirm payment plan are not subject to the 50% deposit structure.
13. Refundable GPS Tracker Deposit
For Embellished Art orders involving the transportation of cremated remains, Tribute Art™ provides a GPS tracker as an additional measure of visibility and reassurance during transit. The tracker accompanies the cremated remains while they are being transported to Tribute Art™ and is included with the completed artwork and any remaining cremated remains for the return journey to the customer.
One $250 refundable GPS tracker deposit is collected at checkout per applicable Embellished Art order. Only one GPS tracker is issued per order, so the deposit is charged once per order regardless of how many Embellished Art pieces the order contains. The tracker deposit is separate from the purchase price of the artwork and from any deposit or partial-payment option selected for the artwork itself.
After the completed artwork has been delivered, Tribute Art™ will provide instructions and a prepaid shipping label for the return of the GPS tracker. The customer is responsible for securely packaging the tracker and returning it in accordance with the instructions provided.
The GPS tracker must be returned within 30 days of delivery of the completed artwork. To meet the return deadline, the customer must tender the tracker to the designated carrier using the prepaid return shipping label provided by Tribute Art™ within 30 days of delivery. Transit time for the tracker’s return to Tribute Art™ does not count toward the 30-day return period.
Once the tracker has been received by Tribute Art™ in returnable condition, the $250 tracker deposit will be refunded to the original payment method, where possible. The time required for the refund to appear may vary depending on the customer’s financial institution or payment provider.
If the tracker has not been tendered to the designated carrier within the 30-day return period, Tribute Art™ reserves the right to retain the $250 tracker deposit.
If the tracker is not returned, is lost after delivery to the customer, or is returned materially damaged beyond ordinary use, Tribute Art™ reserves the right to retain all or an appropriate portion of the tracker deposit.
The GPS tracker is provided as an additional tracking and visibility measure. GPS tracking does not guarantee uninterrupted location information or prevent carrier delays, loss, damage, misdelivery or other transportation-related events.
14. Affirm Financing
Eligible customers may have the option to finance purchases through Affirm.
Financing is provided by Affirm and is subject to Affirm’s eligibility requirements, approval process, terms, conditions, interest rates, and availability.
The Memorial Collective™ / Tribute Art™ does not determine whether a customer qualifies for Affirm financing.
Customers selecting Affirm are responsible for reviewing and agreeing to the applicable financing terms presented by Affirm.
15. Cancellations, Returns & Exchanges
Due to the personalized, artistic, memorial, and/or made-to-order nature of many Tribute Art™ products, certain products are final sale.
In particular, Embellished Art orders are final once placed and cannot be cancelled, returned, or exchanged, subject to applicable law.
Other personalized, custom, made-to-order, and digital products may also be designated as final sale on their applicable product pages.
The $250 refundable GPS tracker deposit is separate from the purchase price of the artwork and is not affected by the final-sale policy above. Although Embellished Art itself is final sale and non-returnable, the tracker deposit remains refundable in accordance with Section 13 – Refundable GPS Tracker Deposit.
A final-sale policy does not prevent us from addressing an order that arrives damaged, contains a verified defect, or materially differs from the product ordered.
Nothing in these Terms limits any rights or remedies that cannot legally be excluded under applicable consumer protection law.
16. Digital Product Sales
Because digital products are created and/or delivered electronically, digital product purchases are final once the applicable creation or fulfillment process has begun, except where otherwise required by law.
Customers are responsible for ensuring that the information, photographs, and instructions submitted for a personalized digital product are accurate.
17. Shipping & Delivery
Processing, production, and delivery timelines vary by product.
For products that are ready for shipment, orders are generally prepared and shipped within the timeframe stated on the applicable product page.
For Embellished Art, a Memorial Kit is generally shipped within 1–2 business days after the order is placed. The kit includes instructions, an appropriately sized memorial bag, a prepaid return shipping label, and a GPS tracker that accompanies the cremated remains on their journey to Tribute Art™. Once the Memorial Kit and cremated remains are received, please allow approximately 2–4 weeks for completion and preparation of the artwork for shipment. Any unused cremated remains are returned with the completed artwork, and the GPS tracker travels with the completed artwork and any remaining cremated remains on the return journey to the customer. The refundable GPS tracker deposit and the tracker return requirements are described in Section 13 – Refundable GPS Tracker Deposit.
Delivery times following shipment vary according to destination and carrier.
Any production or delivery timeframe provided by The Memorial Collective™ / Tribute Art™ is an estimate unless expressly stated otherwise.
18. Shipping Delays
We will make reasonable efforts to fulfill orders within the estimated timelines provided.
Carrier delays, customs processing, weather, supply interruptions, artist or manufacturing delays, and other circumstances outside our reasonable control may affect delivery.
Where tracking information is available, it will be provided after shipment.
For Embellished Art, a GPS tracker accompanies the cremated remains to Tribute Art™ and travels with the completed artwork and any remaining cremated remains on the return journey. The GPS tracker is provided as an additional measure of visibility and reassurance during transit. It does not guarantee uninterrupted location information and does not prevent carrier delays, loss, damage, misdelivery or other transportation-related events.
19. Damaged or Incorrect Orders
If your physical product arrives damaged or materially differs from your confirmed order, please contact us promptly.
We may request photographs of the product, packaging, shipping container, and shipping label to help assess the issue.
Depending on the circumstances, an appropriate remedy may include repair, replacement, correction, or another resolution determined in accordance with applicable law.
Please retain all original packaging until the matter has been resolved.
20. Artist Proofs
Where a product is identified as an Artist Proof, this means it is the first print produced from the original artwork.
Any additional characteristics, artist involvement, embellishment, or other attributes will be described on the applicable product page.
21. Intellectual Property
Unless otherwise stated, the Tribute Art™ website and its branding, logos, trade names, text, graphics, product concepts, photographs, designs, website content, and other materials owned by The Memorial Collective™ / Tribute Art™ are protected by applicable intellectual property laws.
Artwork displayed or sold through Tribute Art™ may remain the intellectual property of the applicable artist.
Purchasing artwork or a product containing an artist’s work does not transfer copyright or other intellectual property rights to the purchaser.
Certain names, phrases, product names, program names, and brand identifiers used throughout the website are trademarks of The Memorial Collective Inc. and/or Tribute Art™, including, where applicable:

22. Digital File Usage
Purchasing a personalized digital file gives the customer the right to use the file for its intended personal purpose.
Unless expressly authorized, purchasing a digital product does not give the customer the right to commercially reproduce, resell, distribute, sublicense, or otherwise commercially exploit the design.
23. Third-Party Services
Certain products or services may involve independent artists, manufacturers, printers, shipping carriers, payment providers, financing providers, funeral professionals, or other third parties.
The Memorial Collective™ / Tribute Art™ may engage these parties where reasonably necessary to create, process, manufacture, embellish, package, deliver, or otherwise fulfill an order.
24. Website Availability
We strive to keep the Tribute Art™ website accurate and available but cannot guarantee uninterrupted or error-free access.
We may update, modify, discontinue, or correct website content, products, features, pricing, or availability at any time.
25. Limitation of Liability
To the extent permitted by applicable law, The Memorial Collective™ / Tribute Art™ will not be liable for indirect, incidental, special, or consequential damages arising from the use of the website or products and services purchased through it.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
26. Privacy
Personal information collected through the Tribute Art™ website and ordering process will be handled in accordance with our Privacy Policy and applicable privacy laws.
Information may be shared with artists, manufacturers, fulfillment providers, payment processors, shipping providers, and other service providers only as reasonably necessary to process and fulfill an order or provide requested services.
27. Changes to These Terms
We may update these Terms periodically to reflect changes to our products, services, business practices, or legal requirements.
The version in effect at the time of your purchase will generally apply to that transaction unless otherwise required by law.
The date at the top of this page identifies when these Terms were most recently updated.
28. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, subject to any mandatory consumer protection rights that may apply based on the customer’s jurisdiction.
